All cases are unique and the circumstances in one may not apply in another.
However, many cases have similarities, especially with regard to the steps the case may go through. In this section, sample cases we have handled over the years are summarized. These cases are meant to provide enough information so you can better understand the types of medical malpractice cases we handle on a regular basis. These are brief summaries of a few cases in which we have succeeded in recovering significant damages for veterans, their families, and dependants of active duty military personnel. We cannot promise the same results for every case and every situation, but we’ll fight as hard as possible for you.

An administrative settlement was obtained on behalf of this veteran who suffered massive, unexpected complications during surgery to repair aortic aneurysm.

- Kidney and ureter damage at VA Medical Center

We filed suit and obtained a settlement on behalf of a veteran who was injured when a VA physician attempted to remove a kidney stone. His injuries included a torn ureter, kidney damage, infection, and partial loss of function.

An administrative settlement was obtained for a woman whose Air Force health care providers failed to properly evaluate her repeated complaints of chest pain, which would likely have avoided her subsequent heart attack.

We filed suit against the United States and recovered damages on behalf of this veteran, who failed to receive colonoscopy or other appropriate colon-cancer screening at Air Force and VA clinics over the course of several years.

The VA settled this claim, which alleged negligence in allowing an elderly, terminally ill vet to suffer head injuries due to a fall at a VA hospital. Restraint orders put in place to protect the patient had not been followed

The United States settled this case after suit was filed on behalf of the surviving spouse and children. Death occurred after doctors and lab personnel at a U.S. Army community hospital failed to diagnose an infection which threatened the life of this woman, who suffered from pre-existing liver disease.

- Death due to delayed diagnosis of bladder cancer

A VA physician failed to obtain follow-up tests when this veteran reported blood in his urine. The result was a fatal delay in diagnosis of bladder cancer. This claim was settled without filing suit.

- Death resulting from a perforated esophagus

This veteran died from respiratory failure while recovering from an injury she received during an upper GI examination at a VA hospital. We filed suit and the government settled the case.

- Death due to failure to treat coronary artery blockage
- Maryland
A retired General obtained a state-of-the-art test which confirmed the presence of coronary artery disease. He informed his Air Force primary care doctors, who then failed to obtain needed follow-up over a sixteen-month period. The General suffered a massive heart attack and died. We filed suit against the United States and obtained a substantial recovery.

- Failure to diagnose clogged coronary artery bypass graft

VA emergency room personnel failed to admit and treat this vet despite abnormal EKG, chest pain, shortness of breath, and a cardiac history. The man was sent home, where he suffered a heart attack. We obtained a recovery for the vet and his wife after filing suit against the government.

We obtained a recovery in litigation on behalf of this retiree, who reported to an Air Force emergency room after experiencing a sudden, partial loss of vision. Doctors suspected a stroke, but due to delays and administrative errors, no treatments were provided in time to avoid his permanent visual and memory deficits.

The infant son of a Marine NCO was hospitalized at an Army hospital for routine surgery. Negligence on the part of a civilian nurse allowed intravenous saline solution to infiltrate the tissues of the baby’s arm. Surgery and extensive tissue removal and cosmetic repairs were required, and the child is expected to suffer a permanent partial arm disability. Our firm filed suit and recovered for the child and his parents.

The VA settled this claim which alleged failure to obtain follow-up treatment for more than fourteen months after this veteran’s CT films were noted to show the presence of an enlarging lung nodule.

- Failure to diagnose mouth cancer
- Oregon
An administrative settlement was obtained for this veteran after VA dentists failed to follow-up an enlarging ulcer on his tongue, which was ultimately diagnosed as cancerous. The veteran suffered pain, more extensive tissue loss during tongue surgery, and permanent speech impairment due to delay in diagnosis.

This case resulted in an administrative settlement for a veteran whose ear was burned by caustic solvent during a cleaning procedure. He suffered additional hearing loss and underwent repair surgery.

- Death due to delay in diagnosing nasopharyngeal cancer
- Washington, D.C.
We obtained an administrative settlement for the surviving spouse after Army primary care doctors failed to refer his wife for specialist evaluation despite her long-standing complaints of blood-tinged mucous and chronic cough.

- Skin discoloration due to medication

The VA settled this claim, which was brought on behalf of a woman who reported an allergic reaction to pain medication after treatment in a VA emergency room. Her medication was not discontinued despite prompt complaints and multiple return visits, and the delayed diagnosis of allergic reaction caused permanent skin discoloration on her face and arms

We filed suit and made a recovery on behalf of this woman and her husband after she suffered loss of a kidney due to ureteral clipping during pelvic surgery. The injury was not discovered for several years, during which time the woman had suffered from chronic pain and loss of energy.

The VA settled this administrative claim. The veteran died while awaiting routine cardiac stress testing despite clear signs of unstable angina and the need for an urgent cardiac work-up.

- Delayed diagnosis of colon cancer

We recovered for this veteran and his wife after filing suit against the government based on the VA’s failure to provide colonoscopy or other appropriate colon cancer screening during years of primary care treatment. When this gentleman’s cancer was finally diagnosed, he required extensive surgery and a permanent colostomy.
