$300,000 for Surviving Adult Children of Deceased Veteran in Nebraska

We were retained by four siblings whose father died from lung cancer that went undiagnosed and untreated for 20 months by his medical providers at a VA hospital in Omaha, Nebraska.

This 69-year-old Army veteran had significant unintended weight loss and had been coughing up blood when he presented to his VA doctors for help. His blood tests and CT scans all showed concerning signs for cancer. But these findings went completely ignored by the veteran’s VA medical providers.


Nearly two years later, he was finally diagnosed with Stage 4 lung cancer, but by then it was too late. This Army veteran passed away from the lung cancer and we pursued a Federal Tort Claim for medical malpractice against the VA on behalf of his surviving adult children.

Thankfully the VA agreed to settle the case for $300,000 after a year in the claims process. For this family, it doesn’t make the loss any easier, but it does help to provide some closure to their fight against the substandard medical care their father received from the VA.
